Information held about you

Your premises are considered to be within 3km of a confirmed outbreak of avian influenza (also known as bird flu).

The government has declared a Protection Zone and a Surveillance Zone around the place where disease has been confirmed to help prevent its spread and any checks which need to be made of all poultry and other captive birds within the 3km Protection Zone.

The information collected by Herefordshire Council will be passed on to the Animal Plant Health Agency (APHA) (part of Defra) and used to assess the risk of avian influenza spread. Herefordshire Council or APHA staff may call you within the next few days to gather further information and visits may need to be made to assess the birds' health.

The information collected and held will include:

  • Name
  • Address
  • Telephone number
  • Email address
  • Details of anyone who has access to the birds or who works at another premise where birds are kept.
  • Type of birds and other animals and number kept at premises
  • How the birds are housed and proximity to areas where wild birds congregate - for example, a pond or lake
  • Any movements of the birds
Who is processing your data

All personal data held is processed in accordance with Data Protection law. The data controller for the information outlined in this privacy notice is Herefordshire Council.

How we will use the information we hold about you

We will collect information about you (where applicable) to help prevent the spread of avian flu and to carry out checks which may need to be made to determine where all poultry and other captive birds are within the 3km Protection Zone.

How the law allows us to use your information

The legal basis for processing the data is our legal obligation under Animal Health Act 1981, Avian Influenza and Influenza of Avian Origin in Mammals (England) (No2) Order 2006 (as amended).

Who we will share your information with

We may share your information with partner organisations, including:

  • Animal Plant Health Agency (APHA)
  • Department for Environment, Food and Rural Affairs (Defra)

We will not normally share your information with organisations other than our partner organisations without your consent, however, there may be certain circumstances where we would share without consent such as where we are required to do so by law, to safeguard public safety, and in risk of harm or emergency situations. Any information which is shared will only be shared on a need to know basis, with appropriate individuals. Only the minimum information for the purpose will be shared.

How long we keep your personal information

We will only keep your information for the minimum period necessary. The information outlined in this privacy notice will be kept for six years. All information will be held securely and destroyed under confidential conditions.

Your rights

You have a number of rights under data protection law, including the right to request your information and to request that the information be amended or erased if incorrect.

To request your records, you will need to put your request in writing and provide proof of identification to the Information Governance Team, Herefordshire Council, Plough Lane, Hereford HR4 0LE or via email, informationgovernance@herefordshire.gov.uk

You also have a right to make a complaint about our handling of your personal data to the Information Commissioner’s Office.
