Herefordshire Council have a duty to provide a household waste collection service within Herefordshire. We also have a duty to provide a business waste collection service within Herefordshire, upon request. Herefordshire Council also have a duty to provide locations where residents can deposit their own waste – these are our Household Recycling Centres.
In order to provide these services efficiently and ensure our records are accurate it is necessary for us to collect and hold personal information about you. As a minimum, this information will include:
- Your address and any service provided to that address for example, whether you have a bin or sacks, what day your household waste is collected.
If you contact us to enquire about your waste collections, request a service, report a missed collection, or to make a complaint we will collect and hold additional personal information about you. This information will include:
- Your contact details: including your name, address, telephone number, e-mail address
- Contact we have had with you, such as home visits, any contact regarding your collections
- Details about the nature of your enquiry
- Who is processing your data

All personal data held, is processed in accordance with data protection law. The Data Controller for the information outlined in this privacy notice is Herefordshire Council.
- How we will use the information we hold about you

We will collect information about you to:
- Provide household waste collection service or business waste collection service.
- Investigate and provide a response to any enquiry or complaint you make
- Ensure our records are accurate
- Contact you to discuss your waste collection service
- Allow Herefordshire Council staff to check that you are a Herefordshire resident and that you are eligible to use the service
- How the law allows us to use your information

The legal basis for processing the data is:
- Under section 45 of the Environmental Protection Act 1990, Herefordshire Council have a duty to provide a household waste collection service and if requested, to collect any commercial waste from commercial premises in Herefordshire.

We may share your information with partner organisations, including in order to:
- Provide you with a response to any queries or complaints you have about your collection service, we need to share some of the details you provide us with our waste collection contractor, FCC Waste Services (UK) Ltd. This information will include your address, contact details any other details you provide that relate to your enquiry. This is to enable an investigation to take place for any enquiry, complaint or request you make and so that they or we can provide you with a response.
- Provide you with a response to any queries or complaints you have about the Household Recycling Centres, we need to share some of the details you provide us with our partner organisation Worcestershire County Council and waste disposal contractor, Severn Waste Services Ltd. This information may include your address, contact details any other details you provide that relate to your enquiry. This is to enable us to investigate any enquiry, complaint or request you make and provide you with a response.
The data you provide is stored within the council’s secure ICT systems, maintained by Hoople Ltd.
We will not normally share your information with organisations other than our partner organisations without your consent; however, there may be certain circumstances where we would share without consent such as where we are required to do so by law, to safeguard public safety, and in risk of harm or emergency situations. Any information which is shared will only be shared on a need to know basis, with appropriate individuals. Only the minimum information for the purpose will be shared.

We will only keep your information for the minimum period necessary. The information outlined in this privacy notice will be held for a maximum period of 3 years; however if you make a formal complaint the information will be kept for 6 years.
All information will be held securely and destroyed under confidential conditions.

You have a number of rights under data protection law, including the right to request your information and to request that the information be amended or erased if incorrect.
To request your records, you will need to put your request in writing and provide proof of identification to the Information Governance Team, Herefordshire Council, Plough Lane, Hereford HR4 0LE or via email, informationgovernance@herefordshire.gov.uk
You also have a right to make a complaint about our handling of your personal data to the Information Commissioner’s Office.
