Herefordshire Council offers professional, objective advice and information for a number of non-statutory discretionary services, including Pre-Application advice. Our professional advice services are for anyone wanting:
- To carry out development, such as building work or engineering work
- To change the use of land or a building
- Comments on altering/extending a listed building
- Advice on repairs to a listed building
- Pre-purchase advice on a listed building
In order to provide this service to you, it is necessary for us to collect and hold personal information about you. This information can include:
- Applicant’s name, address and contact details
- Agent’s name address and contact details
- Contact details for gaining access to the site
- Evidence supporting your application. In the main this will be plans and technical statements but within this you may include personal, financial, medical or ethnic information to justify your application
- Who is processing your data

All personal data held, is processed in accordance with data protection law. The Council will be the Controller for the information outlined in this privacy notice..
We will use this information in conjunction with your submission.

We will collect information about you (where applicable) to:
- Enable the council to respond to your request for pre application planning advice.
- Enable the council to respond to your request for Additional Non Statutory planning advice.
Information may be made available to requesters under the provisions of the Freedom of Information Act 2000 and the Environmental Information Regulations 2003, unless an exemption to release applies.

- Your consent which you can withdraw at any time by notifying us
- Carrying out of a contract to which you are a party
- Our legal obligation under Freedom of Information Act 2000 and the Environmental Information Regulations 2003

We may share your information with organisations other than our partner organisations with your consent, where we are required or allowed by law, to safeguard public safety, and in risk of harm or emergency situations.
We may also share your information for the prevention a detection of crime or to prevent fraud. Any information which is shared will only be shared on a need to know basis, with appropriate individuals. Only the minimum information for the purpose will be shared.

We will keep your information for the minimum period necessary. The information outlined in this privacy notice will be kept as determined by our Retention Policy. All information will be held securely and destroyed under confidential conditions.
