Under the Localism Act 2011, Part 5, Chapter 3, Assets of Community Value (also known as the Community Right to Bid), local communities are able to nominate buildings or land to their local authority to be listed as Assets of Community Value.
To provide the Community Right to Bid services, it is necessary for us to collect and hold personal information about you. This information will include:
- Basic details about you such as name, address, telephone number, email address
- All correspondence concerning the Community Right to Bid process, including letters and emails
- Compensation amounts and reviews
- Land registry notices and restrictions
- Who is processing your data

All personal data held is processed in accordance with data protection law. The data controller for the information outlined in this privacy notice is Herefordshire Council.
- How we will use the information we hold about you

We will collect information about you (where applicable) to:
- Determine if a group meets the eligibility to submit a nomination
- Evaluate a valid nomination
- Conduct a review of a qualifying asset at the landowners request
- Review an intention to bid that is submitted by an eligible community group
- Determine compensation amounts and reviews
- Instruct Land Registry to add and/or remove restrictions
- How the law allows us to use your information

- Our legal obligation under the Assets of Community Value (England) Regulations 2012
- Who we will share your information with

We will share your information with other services provided by the council and third parties, including:
- Herefordshire Council Legal Services, Talk Community and Property Services to establish eligibility of nomination, form the evaluation panel, conduct internal reviews and determine moratorium periods
- The landowner, the initial community group's nomination will be shared once accepted, with relevant personal information redacted including contact information and signatures. If an intention to bid is received, the name of the community group will be shared with the landowner
- The landowner and nominating body, each party will receive all representations made by one another if a review of a qualifying asset is carried out
- Land Registry in order to add and/or remove notices and restrictions
We will not normally share your information with organisations other than our partner organisations without your consent, however, there may be certain circumstances where we would share without consent such as where we are required to do so by law, to safeguard public safety, and in risk of harm or emergency situations.
Any information which is shared will only be shared on a need to know basis, with appropriate individuals. Only the minimum information for the purpose will be shared.
- How long we keep your personal information

We will only keep your information for the minimum period necessary. The information outlined in this privacy notice will be kept for 7 years from the last action. The listing of a nomination will remain on the statutory register for a period of 5 years.
All information will be held securely and destroyed under confidential conditions.

You have a number of rights under data protection law, including the right to request your information and to request that the information is amended or erased if incorrect.
To request your records, you will need to put your request in writing and provide proof of identification to the Information Governance Team, Herefordshire Council, Plough Lane, Hereford HR4 0LE or email informationgovernance@herefordshire.gov.uk
You also have a right to make a complaint about our handling of your personal data to the Information Commissioner's Office.
