About the anti-social behaviour case review process
The Anti-Social Behaviour, Crime and Policing Act 2014 set out that victims of persistent anti-social behaviour can request a review of any actions taken, or not taken in respect of formal reports of anti-social behaviour made to a relevant agency.
Therefore, if you are having continuing problems with anti-social behaviour (ASB), and you have made multiple reports to a relevant agency; whether you are a resident, business or a community group, and the anti-social behaviour is continuing, then you may meet the threshold for an anti-social behaviour case review to be held.
The purpose of the anti-social behaviour case review is:
- To have the responses to your anti-social behaviour reports made reviewed independently
- To determine if adequate or inadequate action was taken and
- To suggest any further actions to be taken to assist in resolving the issue
You can raise an anti-social behaviour case review on someone else's behalf, although you must have their consent first.
The anti-social behaviour case review threshold
In Herefordshire for an anti-social behaviour case review to be held, the threshold is:
- At least three qualifying incidents of anti-social behaviour that have been reported
- Reports must have been made to a relevant agency
- Each report must have been made within 1 month of the incident occurring
- The three reports must have been made within the past 6 months
Or
- One incident of a hate crime or incident within the past 6 months
Please note, the same incident or report, reported to three different agencies will count as one single qualifying report only. The reported anti-social behaviour must be from different instances of anti-social behaviour.
What the anti-social behaviour case review is not to be used for
The anti-social behaviour case review is not to report anti-social behaviour. There must already be a report that agencies are able to have time to respond to and then to review at any anti-social behaviour case review meeting.
The anti-social behaviour case review is not to be used as a complaints process against an agency(s). Vexatious applications will not be accepted. Each agency will have their own individual complaints procedure.
The anti-social behaviour case review cannot consider matters of a civil nature subject to civil law, such as boundary and access issues, high hedges or overhanging trees.
Relevant agencies
A relevant agency could include:
- Herefordshire Council
- West Mercia Police
- A registered social housing provider that you or someone else is a tenant of
- Integrated Care Board (ICB)
Who can use the review process
Any individual - regardless of age, a business and/or a community group can all use the anti-social behaviour case review process.
It can also be used by any person on behalf of an applicant, providing there is consent to do so. The anti-social behaviour case review can also be requested by a professional because it can be considered a useful tool for a multi-agency response to ongoing anti-social behaviour.

The anti-social behaviour case review process is a multi-agency approach to problem solving anti-social behaviour, therefore, by providing us with details about an incident, you are giving us permission to share that information with our partner organisations as set out in the Crime and Disorder Act 1998 and the Data Protection Act 1998.
